Credit Report Authorization/Disclosure/Disclaimer Welcome to the web site, www.3StepCredit.com, (the "Site"). This Service Agreement ("Agreement") contains the terms and conditions upon which you ("you," or the "member") may access 3StepCredit.com or any products through the Site. You agree to be legally bound by these terms. PLEASE READ THE FOLLOWING TERMS AND DISCLOSURES CAREFULLY. BY SUBMITTING YOUR ORDER, YOU ACKNOWLEDGE RECEIPT OF OUR PRIVACY POLICY AND AGREE TO ITS TERMS, CONFIRM YOUR AUTHORIZATION FOR 3STEPCREDIT, INC (“3STEPCREDIT”) TO OBTAIN YOUR CONSUMER REPORT (“BASIC REPORT”), CREDIT SCORES (“SCORES”) AND OTHER ENHANCEMENTS TO THE BASIC REPORT AND AGREE TO THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS OR CONDITIONS, DO NOT USE THE PRODUCTS OR ANY OF THE INFORMATION OR CONTENT WITHIN THE PRODUCTS, DISCARD THE PRODUCTS YOU RECEIVED IMMEDIATELY AND CALL CUSTOMER SERVICE TO CANCEL YOUR MEMBERSHIP. MOREOVER, IN THE CASE OF ONLINE CUSTOMERS, IF YOU DO NOT AGREE WITH ANY OF THESE TERMS OR CONDITIONS, DO NOT ACCESS OR OTHERWISE USE THIS WEB SITE, THE PRODUCTS, OR ANY INFORMATION OR CONTENT CONTAINED ON THIS WEB SITE. YOUR ACCESS TO AND USE OF THIS WEB SITE CONSTITUTE YOUR AGREEMENT TO ABIDE BY EACH OF THE TERMS AND CONDITIONS SET FORTH BELOW. FOR PURPOSES OF THIS AGREEMENT, THE TERM “CREDIT REPORTS” INCLUDES BASIC REPORTS, SCORES, AND OTHER ENHANCEMENTS TO THE BASIC REPORTS, INDIVIDUALLY OR COLLECTIVELY, AS THE CONTEXT REQUIRES.


This Agreement is made between you and 3STEPCREDIT, the provider of credit products including, but not limited to, the membership based products, and credit monitoring, and non-membership based products such as the 3 Bureau Credit Report, Single Credit Report, Free Credit Report, Credit Score, and Free credit Score (collectively, the "Products"), and all text, pictures, graphics, logos, button items, images, works of authorship and other information and all revisions, modifications, and enhancements thereto ("Content") are subject to the following Terms and Conditions.

Note to online customers: These Terms and Conditions may be updated from time to time. Please check this site regularly for updates to these Terms and Conditions.

Use of the Products
By requesting your Credit Report from 3STEPCREDIT.COM, you (1) agree that the information you provide, when prompted to do so by the registration and application forms, is true, current and accurate, and (2) certify that you are the person whose Credit Report is being requested and that you are at least 18 years of age. If any information you provide is untrue, inaccurate or not current, or if 3STEPCREDIT has reasonable grounds to suspect that such information is untrue, inaccurate or not current, 3STEPCREDIT, at its sole discretion, has the right to suspend or terminate your use of any Product and refuse all current or future access to the Content and use of the Products or suspend or terminate any portion thereof. Further, you agree that 3STEPCREDIT will not be liable to you or any third party if 3STEPCREDIT suspends or terminates your access to the Content or Products for any reason.

You understand that by checking the "Accept and Submit" box found on the order form, you are providing "written instructions" to 3StepCredit.com and its affiliates and suppliers, including but not limited to Equidata, Inc. and Trans Union, LLC under the Fair Credit Reporting Act authorizing 3STEPCREDIT, Inc. and its affiliates and suppliers, including but not limited to Equidata, Inc. and Trans Union, LLC, to obtain information from your personal credit profile from Experian and/or Equifax and/or TransUnion. You also authorize 3StepCredit.com to access your personal credit profile to verify your identity and review your credit file in order to provide credit monitoring, scoring and related products.


YOU UNDERSTAND THAT IT MAY BE A VIOLATION OF FEDERAL AND/OR STATE LAW FOR YOU TO OBTAIN A CREDIT REPORT ON ANY PERSON OTHER THAN YOURSELF, AND THAT UNDER THE FCRA, ANY PERSON WHO KNOWINGLY AND WILLFULLY OBTAINS INFORMATION ON A CONSUMER FROM A CONSUMER REPORTING AGENCY UNDER FALSE PRETENSES SHALL BE FINED UNDER TITLE 18, UNITED STATES CODE, IMPRISONED FOR NOT MORE THAN 2 YEARS, OR BOTH.

Arbitration
YOU UNDERSTAND AND AGREE THAT ALL CLAIMS, DISPUTES OR CONTROVERSIES BETWEEN YOU AND 3STEPCREDIT, AND ITS AFFILIATES, SUBSIDIARIES OR RELATED COMPANIES, INCLUDING BUT NOT LIMITED TO TORT AND CONTRACT CLAIMS, CLAIMS BASED UPON ANY FEDERAL, STATE OR LOCAL STATUTE, LAW, ORDER, ORDINANCE OR REGULATION, AND THE ISSUE OF ARBITRABILITY, SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION AT A LOCATION DETERMINED BY THE ARBITRATOR. ANY CONTROVERSY CONCERNING WHETHER A DISPUTE IS ARBITRABLE SHALL BE DETERMINED BY THE ARBITRATOR AND NOT BY THE COURT. JUDGMENT UPON ANY AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED BY ANY STATE OR FEDERAL COURT HAVING JURISDICTION THEREOF. THIS ARBITRATION CONTRACT IS MADE PURSUANT TO A TRANSACTION IN INTERSTATE COMMERCE AND ITS INTERPRETATION, APPLICATION, ENFORCEMENT AND PROCEEDINGS HEREUNDER SHALL BE GOVERNED BY THE FEDERAL ARBITRATION ACT ("FAA"). NEITHER YOU NOR WE SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER CONSUMERS OR ARBITRATE ANY CLAIM AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. THE PARTIES VOLUNTARILY AND KNOWINGLY WAIVE ANY RIGHT THEY HAVE TO A JURY TRIAL.

Fair Credit Reporting Act The Fair Credit Reporting Act (“FCRA”) allows you to obtain a copy of all of the information in your consumer credit file disclosure from consumer reporting agencies for a reasonable charge. Full disclosure of information in your file at the three national credit repositories must be obtained directly from the repositories by calling:

Experian: 1-800-EXPERIAN (1-888-397-3742)
Equifax: 1-800-685-1111
Trans Union: 1-800-916-8800

The FCRA also states that individuals are entitled to receive a disclosure directly from the consumer reporting agency free of charge under the following circumstances:

* You certify in writing that you are unemployed and intend to apply foremployment in the next 60 days;
* You are on public welfare assistance
* You have reason to believe that your file at the consumer reporting agency contains inaccurate information due to fraud
* You have been denied credit, insurance, or employment within the past 60 days as a result of your Credit Report.

The FCRA also permits consumers to dispute inaccurate information in their Credit Report without charge. Accurate information cannot be changed. You do not have to purchase your Credit Report or other information from 3STEPCREDIT to dispute inaccurate or incomplete information in your credit file maintained by Experian, Equifax or Trans Union (the “Repositories”).

The Credit Report you are requesting from 3STEPCREDIT is not intended to constitute thedisclosure of Experian, Equifax or Trans Union information required by the FCRA or similar state laws.

Beginning December 1, 2004, the FCRA allows consumer to get one free comprehensive disclosure of all the information in their credit file from each of the Repositories once every 12 months through a central source. Georgia residents can receive two disclosures per year. Although comprehensive, the Credit Reports from each of the Repositories that are available from the 3StepCredit.com Web Site may not have the same information as a credit report obtained directly from the three Repositories or through 3StepCredit.

Consumers residing in the states of Colorado, Maine, Maryland, Massachusetts, New Jersey, and Vermont may receive an additional free copy of their credit report once per year and residents of the state of Georgia may receive two (2) additional copies per year. For Illinois residents, credit reporting agencies are required by law to give you a copy of your credit record upon request at no charge or for a nominal fee.


It may be the policies of Equifax, Experian and/or TransUnion to provide a complimentary copy of the consumer credit report under circumstances other than those described above. If you wish to contact Equifax, Experian or TransUnion to obtain a copy of your credit report directly from such agency or if you wish to dispute information contained in an Equifax, Experian or TransUnion credit report file, see the contact information and dispute process description contained in the FAQs available from most pages of the Site. The form of credit report and related disclosures provided directly by such agencies to you may differ from those provided by 3STEPCREDIT.

3STEPCREDIT's online credit report has been specially designed for consumer ease-of-use. Color illustrations, analysis information and helpful links on 3STEPCREDIT's credit report make it easy for you to understand and manage your credit.

General Terms
3STEPCREDIT maintains the Site to provide you with information about our memberships, products and services and to facilitate communication with us and our affiliates. From time to time we may revise these terms and conditions. Revisions will be effective when posted or as otherwise stated. Additional terms and conditions may apply to specifics of our memberships, products and services or to participate in our affiliate program, contests or surveys.

The Content used and displayed on the Site, including but not limited to 3StepCredit.com are the property of 3STEPCREDIT or its licensors and are protected by copyright, trademark and other laws. In addition to its rights in individual elements of the Content within the Site, 3STEPCREDIT owns copyright or patent rights in the selection, coordination, arrangement and enhancement of such Content. You may copy the Content from the Site for your personal or educational use only, provided that each copy includes any copyright, trademark or service mark notice or attribution as they appear on the pages copied. Except as provided in the preceding sentence, none of the Content may be copied, displayed, distributed, downloaded, licensed, modified, published, reposted, reproduced, reused, sold, transmitted, used to create a derivative work or otherwise used for public or commercial purposes without the express written permission of 3STEPCREDIT or the owner of the Content.

SOME JURISDICTIONS EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGREEMENTS; FOR THESE JURISDICTIONS, THE AFOREMENTIONED LIMITATION ON LIABILITY SHALL BE TO THE MAXIMUM DEGREE PERMITTED BY APPLICABLE LAW. IF, NOTWITHSTANDING THE ABOVE, LIABILITY IS IMPOSED UPON 3STEPCREDIT, THEN YOU AGREE THAT 3STEPCREDIT’S TOTAL LIABILITY FOR ANY OR ALL OF YOUR LOSSES OR INJURIES FROM 3STEPCREDIT’S ACTS OR OMISSIONS, REGARDLESS OF THE NATURE OF THE LEGAL OR EQUITABLE CLAIM, SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO 3STEPCREDIT FOR THE PRODUCT(S) YOU PURCHASE FROM 3STEPCREDIT.

You understand and agree that we provide a credit monitoring product. We give you access to your credit report and we help you understand the information contained in your credit report. We are not a credit repair organization. We cannot improve your credit report, credit history or credit rating. We do not provide you with advice or assistance in improving your credit report, credit history or credit rating. Accurate adverse information on your credit report cannot be changed. If you believe that your credit report contains inaccurate information, it is your responsibility to contact the relevant credit reporting company, and follow the appropriate procedures for notifying the credit reporting company that you believe that your credit report contains an inaccuracy. Any information provided to you regarding the procedures followed by the various credit reporting companies related to the removal of inaccurate information is provided without charge to you and is available for free. Any such information is not included as part of your credit monitoring product but is provided free of charge to all consumers, regardless of whether they are members of the credit monitoring product.

For online customers, if you are inactive (have not clicked on an item or refreshed the page) for a period of 20 minutes or more when reviewing your credit report and/or credit score online, your session will conclude and you will be logged out for your protection.

Notice of Prosecution
For online customers, access to and use of password protected and/or secure areas of the Web Site are restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Web Site may be subject to prosecution.

Failure to comply with the FCRA can result in state or federal enforcement actions, as well as private lawsuits. In addition, any person who knowingly and willfully obtains a consumer credit report or disclosure under false pretenses may face criminal prosecution.

Our Privacy Policy
By using our Site, becoming a member of one of our membership programs, or purchasing any of our products or services, you agree that we may use and share your personal information in accordance with the terms of our Privacy Policy. In the event you indicate that you want to receive offers from 3STEPCREDIT, your information may be used to serve relevant ads to you when you visit the site. Disclaimers
Because of the security measures we have implemented on our Site are designed to protect your privacy and to safeguard your information, we may not always be able to successfully provide our Products to you, including instant online delivery of your credit report for online customers. For example, for certain of our online Products, when the system is unable to verify your identity online, you may be routed through a manual authentication process. For other products, we cannot offer a manual authentication process and will be unable to fulfill your order if you fail online authentication one or more times.

3STEPCREDIT may use your personal information to the extent necessary to process your order and/or engage in business maintenance.

You must have an email address and a Java-compatible browser such as Netscape Navigator 6.0 or higher, Internet Explorer 5.0 or higher, or AOL 8.0 or higher to receive your Products online.

3STEPCREDIT is not responsible for any overdraft/over-the-limit charges or bank fees if your account contains insufficient funds when your order is processed and billed. We recommend using a credit card rather than a debit card. Canceling too close to end of trial or renewal date may cause a processing delay and a charge to your account. If you are eligible for a refund, refunds can take 7-10 business days to be processed.

3STEPCREDIT is not obligated or responsible for providing assistance for any request based on (a) an act of fraud, deceit, collusion, dishonesty or criminal act by you or any person acting in concert with you, or by any authorized representative of you, whether acting alone or in collusion with you or others, (b) authorized charges that you have disputed based on the quality of goods or services, (c) authorized account transactions or trades that you have disputed, or are disputing, based on the execution (or non-execution) of electronic transfers, trades or other verbal or written instructions or directions, (d) losses, damages or expenses arising out of any business pursuits, (e) losses, damages or expenses that were incurred or commenced prior to the membership, or (f) theft or damages of traveler's checks, tickets of any kind, negotiable instruments, cash or its equivalent, circulating currency, passports, documents, real property, animals, living plants or consumable items, motorized vehicles of any type, watercraft, aircraft, and items intended for storage, transport, display or habitation.

3STEPCREDIT, including its agents, independent contractors, assigns or other expressly authorized third party, reserves the right to make an independent investigation of the facts and circumstances related to any assistance request, including making contact by telephone, email, US Postal Service or otherwise, any service provider or related party it deems necessary, at its sole and absolute discretion and expense, regardless of whether you provide express authorization to make such contact for purposes of verifying and assisting you with your assistance request.

3STEPCREDIT reserves the right to request that you provide corroborating evidence of the unauthorized transaction, Identity Theft or other facts related to your assistance request, including a signed affidavit, law enforcement or governmental agency reports, receipts of expenses, insurance declaration forms, or any other corroborating evidence that we may deem necessary and reasonable.

Product-Specific Terms And Conditions
The terms explained below are product specific and apply to the particular product indicated in addition to the Terms and Conditions listed above. Note: If you have not ordered a specific product listed below, then the related terms and conditions may not apply.

To enroll in a monthly/annual credit monitoring Product or to request a credit report or score, you must have an address within the United States, provide a valid Social Security number, and you agree to be bound by these Terms and Conditions. In other limited circumstances, you may need to provide a valid telephone number so that 3STEPCREDIT can process your order. You must provide valid credit card information. We will then evaluate your complete registration information. We are not able to accept and process joint registration for a married couple.

Cancellation Policy
We process requests for all credit reports promptly and immediately incur a charged by each of the credit reporting agencies for their data. Therefore, we have a NO REFUND policy for credit reports that are deliverable by us online. If you have selected to upgrade to receive credit monitoring you will be given a three day period in which to cancel your service. Free Trial
You may cancel your 3STEPCREDIT Credit Monitoring membership at any time during the trial period without charge. If you wish to continue your membership in 3STEPCREDIT Credit Monitoring beyond the trial period, do nothing and your membership will automatically continue without interruption. The monthly fee (plus sales tax, if applicable) will be charged to your credit card account at the conclusion of the trial period and your membership will continue automatically, billable monthly at the prevailing rate. When you become a member entitled to 3STEPCREDIT Credit Monitoring, you understand that it is a membership that automatically renews itself every month indefinitely without action by the member on the monthly anniversary day of your initial purchase. Your membership in credit monitoring is effective for the period covered by your membership fee and continues upon your payment of the monthly/annual renewal fee. Renewal fees for your membership will automatically be charged, at the then current rate (that was most recently used on the Site), to the credit card or other billing source authorized by you, until you cancel your membership. You will be asked for valid credit card information when you sign up for the credit monitoring trial. 3STEPCREDIT will verify your credit card information before processing your order. An authorization will be performed on your credit card, to make sure it is valid and in good standing, but 3STEPCREDIT will not bill your card until the free trial period has passed. Should your credit card fail to authorize, 3STEPCREDIT reserves the right to cancel or suspend the benefits of your membership (including, without limitation, online credit reports and daily monitoring alerts) until payment is received. An enrollee whose membership fee has been paid is entitled to all privileges included in the membership until the membership is cancelled by the enrolled member. Upon cancellation, the member loses access to the areas of the Site designated for members only and loses access to the member's data and other benefits. This could include any credit data and analyses that have been displayed during the membership.

A member may cancel at any time. Should you decide to cancel your subscription a Customer Service representative can arrange for all future renewal fees to be cancelled. However, please note that it is our policy to give neither full nor pro-rated refunds for the current month or any preceding months. If you are an annual subscriber and choose to cancel within 180 days of when you were billed, you will be eligible to receive a prorated refund of your current year's membership fee. The free trial is available one time only per customer in any 365 day period beginning with the date of the order. Once the free trial has been cancelled all subsequent orders will be billable at the prevailing monthly subscription rate. 3STEPCREDIT reserves the right to change the membership fee for any renewal term to be effective upon the renewal of your membership.

Membership
Credit reports, credit scores and debt analysis will be available for a period of up to two months. With respect to products that include access to new credit reports at your discretion, there is a limit of one new credit report every 24 hours. Enrollment in a monitoring program will usually occur within 24 hours but may be delayed. Please note, there are different processing times across the credit reporting companies. It may take 2- 3 weeks for you to be enrolled in the credit monitoring programs in any one of the companies and before you begin receiving alerts.

Memberships, such as monitoring products, automatically renew indefinitely without action by the member, and the membership fee is charged to the member at the time of renewal. An enrollee whose membership fee has been paid is entitled to all privileges included in the membership until the membership is cancelled by the enrolled member. Consent to obtain credit data to fulfill the benefits of subscription products shall be valid under the program until cancelled. Upon cancellation, the member loses access to the areas of the Site designated for members only. This could include any credit data and analyses that have been displayed during the membership. A member may cancel at any time. If you are an annual subscriber and choose to cancel within 180 days of when you were billed, you will be eligible to receive a prorated refund of your current year's membership fee. When you become a member entitled to 3STEPCREDIT Credit Monitoring, 3-Bureau Credit Monitoring, Debt Monitoring and/or Credit Score Monitoring, you understand that it is a membership that automatically renews itself indefinitely. 3STEPCREDIT will charge the membership fee to the credit card or bank account that was last used on the Site, at the then prevailing rate, and your membership will continue automatically.

You understand that 3STEPCREDIT.COM is not a credit bureau, that 3STEPCREDIT.COM and its products are solely mechanisms of communication for you to obtain the credit report, and 3STEPCREDIT.COM assume no responsibility or liability whatsoever for it.

Term and Termination; Modification
This Agreement will take effect at the time you click "Accept and Submit," and shall terminate (a) when the member cancels his/her membership by contacting 3STEPCREDIT via the toll-free number set forth on the web site for cancellations, or (b) upon termination of your membership or (c) if 3STEPCREDIT discontinues providing any membership, subject to your right to receive membership benefits that you have paid for or to obtain a refund of a portion of your payment.

3STEPCREDIT may (i) change the terms of this Agreement or the feature of the membership products, or (ii) change the Site, including eliminating or discontinuing any content or feature of the Site, restricting the hours of availability, or limiting the amount of use permitted, by posting notice of such modification on a page of the Site before the modification takes effect. All changes shall be effective immediately upon posting of such notice. If you use the Site and/or your membership after 3STEPCREDIT has posted a change in the Agreement, you agree to be bound by all of the changes. You are expected to review the Site periodically to ensure familiarity with any posted notices of modification. 3STEPCREDIT may, at its discretion, modify or discontinue any of the Products or Content or a portion thereof, with or without notice. You agree that 3STEPCREDIT will not be liable to you or any third party for any modification or discontinuance of any of the Products or Content.
